Birmingham City Council has taken a significant step by effectively declaring itself in financial turmoil. They've done this by issuing a Section 114 (3) notice, a move that indicates a dire financial situation.

This legal move, outlined in the UK Local Government Act, comes into play when a local authority's spending for a fiscal year is projected to surpass the available resources, including borrowed funds. Birmingham City Council has found itself in this predicament due to the weight of Equal Pay claims and a staggering budget deficit of approximately £87 million.

Back in June, the council revealed a potential Equal Pay claims liability ranging from £650 million to £760 million, with monthly accruals of £5 million to £14 million. The gravity of this financial burden has left the council in a challenging position, as they lack the necessary resources to cover these mounting expenses.

In response to this fiscal crisis, Fiona Greenway, the Council's Interim Director of Finance and Chief Finance Officer, has issued a report under section 114(3) of the Local Government Act. This report confirms the council's inability to meet the Equal Pay expenditure and its current lack of alternative means to address this substantial liability.

To regain control over their finances, the council has implemented stricter spending controls, placing them under the purview of the Section 151 Officer. This move signifies a halt to all new expenditures, except those directed towards protecting vulnerable individuals and essential statutory services.

Despite this financial setback, the Council's senior officers and members are committed to addressing the situation head-on. They pledge to keep the public informed as more information becomes available on their efforts to navigate these turbulent financial waters.
